How to Use SQE2 Assessment Specification

The SRA provides Guidance on the SQE2 Assessment Specification to address common questions regarding the interpretation of the specifications and, in particular, the Functioning Legal Knowledge (FLK). The SRA emphasises that detailing the FLK excessively is neither practical nor beneficial, as doing so may create confusion and result in an overly large and cumbersome body of information.

According to the SRA, the Assessment Specification should be understood in its entirety instead, with particular attention to sections such as Practice Areas, Level of Legal Detail Required, Application of Law, Correct and Comprehensive Application of Law, and Legal Materials. Additionally, the overview, assessment objectives, and criteria for each assessment are crucial for understanding the expectations.

The SQE2 assessments aim to evaluate legal skills within the framework of fundamental legal rules and principles, aligning with the competency level of a newly qualified solicitor. The questions are not intended to test specialist areas of practice that a 'Day One Solicitor' would not typically encounter. Instead, they focus on central, well-established areas of the FLK. To maintain fairness and integrity, all stakeholders are provided access to information about the Assessment Specifications simultaneously.

There is an annual review process for the FLK to ensure its relevance and accuracy. This review accounts for updates in the law and legal practice, incorporates feedback from stakeholders, and makes necessary clarifications or essential adjustments. Questions raised by stakeholders are integrated into this review process to foster a dynamic and adaptive approach to maintaining the relevance and effectiveness of the assessment.
