The Legal Drafting assessment in SQE2 is a computer-based task that tests your ability to draft a legal document or specific parts of a legal document in a way that reflects professional legal practice. You may be required to draft entirely from scratch, draft using a precedent, or amend an existing draft. The exercise simulates the type of work solicitors routinely undertake in client matters across various practice areas.
You are given 45 minutes to complete the task. The drafting may relate to any of the five SQE2 practice areas, including Business Law and Practice, Criminal Practice, Dispute Resolution, Property Practice, and Wills and the Administration of Estates, and may involve documents such as contracts, court applications, client instructions, clauses in agreements, witness statements, or wills. The instructions provided will set out the context of the task and may include guidance from a supervising partner or background documents relevant to the matter.
To perform well in this assessment, you must demonstrate two core competencies: legal accuracy and clear, professional drafting skills. The document must be legally correct, meaning that the content reflects the correct application of law to the facts, and must also be legally comprehensive, addressing all necessary components of the task. Any legal, ethical, or professional conduct issues that arise must be identified and dealt with appropriately.
Equally important is the clarity and precision of language. The draft must be written in a way that is clear, concise, and free from ambiguity. Legal drafting should be tailored to its intended audience, typically clients, other solicitors, or the court, and should avoid unnecessary legalese or complexity. Proper spelling, grammar, punctuation, and formatting are essential.
In addition, you are assessed on the structure and organisation of the document. The draft should follow a logical sequence, use appropriate headings and subheadings where relevant, and present information in a professional format consistent with legal practice.
