The Sentencing Act 2026 received Royal Assent on 22 January 2026. The provisions introduced by the Act are being implemented in stages.
From 2 September 2026 onwards, the new Earned Progression Model, which allows eligible prisoners serving Standard Determinate Sentences (SDS) to be released at the one-third (33%) point, together with other remaining provisions, will be phased in.
The examinable law and practice cut-off date for January 2027 SQE1 is 11 September 2026. This means that the coming SQE1 assessment will cover changes introduced by the new legislation that are effective up to and including 11 September 2026, including the reforms that come into force on 2 September 2026.
There has also been ongoing discussion and uncertainty surrounding the early release reforms. On 22 July 2026, Prime Minister Andy Burnham indicated his intention to review the early prisoner release policy following public concern that certain serious offenders could benefit from earlier release.
Although the SRA has confirmed that developing areas of law are not tested in the SQE, we recommend that you remain aware of the changes.
